Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the AapkeSitare platform — including its website (www.aapkesitare.com) and mobile applications (collectively, "Services"). Patrons are requested to read these Terms carefully before accessing any Service.

By registering, accessing, clicking "I Agree", or using any part of the platform, you agree to be legally bound by these Terms. If you do not agree, you must not use our Services.

2. Description of Services

AapkeSitare provides astrological content, reports, data, telephone and chat consultations, SMS, email, and direct consultation services via the World Wide Web, electronic mail, and mobile/tablet applications. This includes Vedic astrology, numerology, tarot reading, palmistry, Kundli generation, horoscope predictions, Puja bookings, and digital/physical astrological products.

General Services (free content such as daily horoscopes and Panchang) may be accessed without registration. Personalised Services — including live consultations, wallet top-ups, and personalised reports — require registration as a member. All use of and reliance on these Services and predictions is entirely at the user's own discretion, understanding, and responsibility.

2.1 Not a Substitute for Professional Advice

Consultations on AapkeSitare do not constitute medical, psychological, legal, financial, or any other professional advice. Users must not make critical life decisions solely on the basis of astrological consultation. Always consult qualified, licensed professionals for medical, legal, or financial matters.

3. Member Eligibility

The Services are available only to individuals who can form legally binding contracts under applicable law. The Services are not available to:

• Minors — individuals under the age of 18 (or the applicable legal age of majority in their jurisdiction).
• Members whose accounts have been temporarily or permanently suspended by AapkeSitare.
• Corporations or business entities acting in a commercial resale capacity without AapkeSitare's express written consent.

4. Member Registration & Account Security

Upon registration, you will receive a unique AapkeSitare account ID and password. The following obligations apply:

• You must provide accurate, current, relevant, and complete Registration Data and must maintain and update this information to keep it current and accurate at all times.
• You are entirely responsible for maintaining the confidentiality of your account ID and password, and for all uses of your account.
• Your account, ID, and password are personal to you and may not be transferred, shared, or sold to any other party.
• You agree to immediately notify AapkeSitare at support@aapkesitare.com of any unauthorised use of your account or any other breach of security known to you.
• AapkeSitare reserves the right to suspend or terminate accounts where Registration Data cannot be verified or where false information has been provided.

5. Platform Access to Your Account

In order to provide high-quality services, respond to customer needs, and comply with applicable laws, you hereby consent to AapkeSitare employees and authorised agents being able to access your account and records on a case-by-case basis to investigate complaints, allegations of policy violations, or suspected abuse. This access will always be conducted in accordance with our Privacy Policy.

6. Wallet, Payments & Charges

• Wallet balances are non-transferable, personal to the registered account, and are not exchangeable for cash except as provided in our Refund Policy.
• Consultation charges vary by astrologer and are clearly displayed before initiating a session. Charges are deducted per minute for live call and chat sessions.
• All prices are inclusive of applicable taxes unless stated otherwise. Prices may be revised without prior notice.
• Payments are processed securely through third-party payment gateways. AapkeSitare does not store full payment card details on its servers.
• For failed transactions where your bank was debited, contact support@aapkesitare.com within 7 days with your transaction reference.

7. First Free Session Policy

New users are eligible for one complimentary first consultation session (call or chat). This offer is strictly limited to one per user, per registered mobile number, per device. Any attempt to abuse this offer through multiple registrations or technical manipulation may result in immediate account suspension.

8. Report Ordering Policy

Users are requested to exercise due discretion and care while ordering reports. Please double-check all birth details (date, time, and place of birth) before submission.

• Reports are manually prepared and personalised. Minor human delays may occur and will not constitute grounds for a refund.
• Refund requests citing incorrect data provided by the customer will not be entertained under any circumstances.

9. Member Conduct & Prohibited Activities

Your right to use the Services is personal to you. You agree to comply with all applicable local, national, and international laws and regulations. You agree:

• Not to use the platform for any unlawful purpose or in violation of applicable laws, including Indian laws regarding transmission of data exported from India.
• Not to resell, sublicense, or make any commercial use of the Services without AapkeSitare's express written consent.
• Not to use the platform for chain letters, junk mail, spamming, or unsolicited distribution.
• Not to transmit any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
• Not to transmit material that encourages conduct constituting a criminal offence or giving rise to civil liability.
• Not to attempt to gain unauthorised access to any computer systems, servers, or accounts.
• Not to interfere with or disrupt other users' use or enjoyment of the platform or Services.
• Not to harass, abuse, threaten, or defame any astrologer or user.
• Not to impersonate any person or entity, or manipulate ratings, reviews, or platform data.
• Not to scrape, mine, or systematically extract data from the platform.
• Not to ask astrologers for predictions related to black magic, death dates, afterlife, or matters that breach the sanctity of astrological practice.
• Not to exploit free session offers through fraudulent means, multiple registrations, or technical circumvention.

10. Inactive Accounts

AapkeSitare reserves the right to delete or deactivate user accounts and stored communications if the account has been inactive for more than ninety (90) consecutive days. Users will be notified where practicable before such deletion.

11. Astrologer Relationship

Astrologers on AapkeSitare are independent practitioners, not employees or agents of AapkeSitare. AapkeSitare verifies their credentials and monitors quality but does not take responsibility for specific statements, predictions, or advice made during consultations. Any advice or remedy suggested by an astrologer represents the independent opinion of that practitioner alone.

12. Intellectual Property & Proprietary Rights

All content on the platform — including text, software, graphics, photographs, video, audio, reports, and commercially produced information — is protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws. You are not permitted to copy, use, reproduce, distribute, perform, display, or create derivative works from any such content unless expressly authorised by AapkeSitare in writing. These Terms inure to the benefit of AapkeSitare's successors, assigns, and licensees.

13. Disclaimer of Warranties

The platform and all Services are provided on an "as is" and "as available" basis. AapkeSitare disclaims all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, title, or non-infringement. AapkeSitare makes no warranty or representation regarding:

• The results that may be obtained from the use of content or Services.
• The accuracy or reliability of any content obtained through the Services.
• Any goods or services purchased or obtained through the platform.
• That the Services will at all times be uninterrupted, timely, 100% secure, or error-free.

14. Limitation of Liability

In no event will AapkeSitare or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages — including damages for loss of profits, loss of data, or unauthorised access to or alteration of user transmissions or data — arising out of or in connection with the platform or Services, even if AapkeSitare had been advised of the possibility of such damages.

Our aggregate liability to any user for any claim arising under these Terms shall not exceed the amount paid by that user to AapkeSitare in the three months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless AapkeSitare and its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants, and agents from any and all third-party claims, liability, damages, and/or costs (including reasonable legal fees) arising from your use of the Services, your violation of this Privacy Policy or these Terms, or your violation of any third party's rights.

16. Notices

All formal notices to AapkeSitare shall be in writing and made via email or registered post. Notice shall be deemed given 24 hours after an email is sent, or 3 days after deposit in the post. Notice to users will be sent to the registered mobile number or email address provided in Registration Data.

17. Dispute Resolution & Arbitration

We encourage users to contact our customer support team at support@aapkesitare.com to attempt an informal resolution before initiating formal proceedings. Any dispute that cannot be resolved informally shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), as amended. The arbitration shall be conducted by a sole arbitrator in India, and proceedings shall be in English.

18. Modification of Services & Termination

AapkeSitare may modify, suspend, or discontinue any of its Services or your membership account, with or without notice, for any reason. AapkeSitare reserves the right to terminate your account immediately for: (a) inability to verify Registration Data; (b) actions that may cause legal liability; or (c) violation of these Terms or the Privacy Policy. Any unused wallet balance upon termination will be handled per our Refund Policy.

19. General Provisions

• Governing Law: These Terms are governed by and construed in accordance with the laws of India.
• Severability: If any provision is found to be unenforceable or invalid, the remainder of these Terms shall continue in full force and effect.
• Waiver: Any waiver of any provision will be effective only if in writing and signed by an authorised representative of AapkeSitare.
• Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between the parties and supersede all prior understandings or agreements regarding such subject matter.
• Headings: Section headings are for reference only and do not define, limit, or describe the scope of any section.
